Female model used adultery law to sue porn company

Porn lawA female porn actress recently tried to sue porn company BangBros over the 2008 straight video Isabella's Turn.
 
The video was shot in a warehouse outside of Miami. The actress signed a contract and consented to be filmed. However, this past April "Isabella" filed an 11-page lawsuit - which also named film studio Venetian Productions and several affiliate sites - claiming her porn contract was "illegal and unenforceable" because it showed "sexual intercourse outside of marriage, which violates the public policy of the State of Florida."
 
She said that because she was married at the time the contract was not valid, and the video was an "invasion of her privacy." She demanded restitution.
 
The Florida law she was relying on makes it a punishable offense for individuals to have sex outside of marriage, and for "any man or woman, married or unmarried, [to engage] in open and gross lewdness and lascivious behavior." The law is seldom enforced.
 
Isabella's real identity has not been revealed. Her lawyer, Lawrence Metsch, withdrew the lawsuit the same day it was filed, leaving many to speculate that a settlement had been reached. BangBros would not comment.
 
Although this case is over, it may inspire other porn actors to sue in order to get more money for their old scenes.
 
"If this were to apply to all adult films, this would not make adult films illegal but would make contracts in this field void," UM associate law professor Andrew B. Dawson argued. "This would allow the actor to later bring the sort of invasion of privacy allegations as Isabella sought here, since the actor's consent to use of his image for distribution would likewise be void."
 
He added: "Effectively, it would give the actor the right to seek to stop the film from being distributed (perhaps just to get his image off the internet) or to ask for more money, especially when the video was more profitable than the actor had anticipated."
