Late yesterday, following news that Donald Trump banned trans individuals from serving in the military, the US Department of Justice decided to pile onto the LGBT community by claiming that Title VII of the Civil Rights Act of 1964 does not protect gay workers from discrimination.

 

“The sole question here is whether, as a matter of law, Title VII reaches sexual orientation discrimination," argued lawyers for the government. "It does not, as has been settled for decades. Any efforts to amend Title VII’s scope should be directed to Congress rather than the courts."

 

The brief was officially filed under Attorney General Jeff Sessions in the case of Zarda v. Altitude Express. Donald Zarda, now deceased, launched a complaint in 2010 alleging that his employer discriminated against him because of his sexual orientation.

 

The Equal Employment Opportunity Commission supported Zarda last month; the DOJ, however, is now claiming the EEOC was "not speaking for the United States.”
